In May 2006, I received a fax from this compaany in Florida telling me abour all vacations I can take, 3 days in Daytona Beach, a cruise to the Bahamas. I contacted them and I was told that this was a great vacation and all that. I sent checks for different things.

I had to give the amount of my yearly salary as well as my husband. Well in August of 2006 we went down there. The very next day this woman came over and stated asking us all sorts of questions about when we take vacatin and how ofent we take vacations and began telling us how much money we would pay if we just went on vacations on our own. She told us we needed to come to the office the next day. When we said we want time to thing about buying a timeshare, she went and got her boss and he came out and said, this is not FREE, it cost money to bring you down here. They pressure my husband and me into buying this timeshare. I had just been informed that I was very sick and my defense was very very low. They
knew that we could not go on vacation the following year because it was already past the time in whcih we would have needed to book our week. When I called to book our week in February of 2007, a man answered and told me you don't have a week to chose, you have already missed you week. He told me I would have to wait until 2008. When I called in 2008 I book a week in Argentina for June of 2008. Calypso Cay Vaction Villas cancelled my week and told me again I did not have a week to book or exchange. So happended when I had called and booked my week to go to Argentina, I had gotten the name of the person that I had spoken to. When I called back, they changed their tune about my week. However, I had to pay a lot of fees to be able to go away.
I' am hoping that we can all get togother and hopefully have our STATES filed a CLASS ACTION LAW SUIT FOR ALL OF US THAT HAVE BEEN EXPLOITED AND RIPOFF AND FINALY STOP THESE COMPANIES. If after reading this article and you feel like I do, please respond.

Hi,
I am speaking with an attorney about filing a class action lawsuit. I am done dealing with their scam. I assume you also received the special assessment letter they just sent out requesting $290 or so for renovations! It is ridiculious. I am hoping we can get everyone together that has posted comments to get this lawsuit filed. Are you interested? I will see if I can have the attorney run a class action lawsuit for this company in the paper so hopefully we can get a ton of people involved!

I am in full agreement with you. I just received the bill for $295 for some kind of renovations. I have stayed here a few times since my husband and I signed on for this timeshare but only for every other year, yet we get the maintance fee dues every year. I had tried about a year and a half ago to get my money back and when told no, I tried to sell with no such luck, then I just stopped paying all together. At that point I was called and harrassed by one of there lawyers and told that if I did not pay everything that I owed and extra that they would attach a lein to my house. I have a family and could not take the risk of loosing my ouse to these people so I sucked it up and ended up paying. Please count me in on any type of lawsuit.

I am in, We are really tired of being ripped off . We have been owners for about 7 yrs. and every year your maintenance fees go up. when you try to make a reservation you get a run around. you can never go the week you want unless they approve it. The people who work there are rude and think they own you. the fact they can raise the fees any time they want is a joke. Another 290.00 added to your fee in absolutely ridiculous.

I also received the "special assessment" letter they just sent out requesting $290 or so for renovations.I pay 670.00 per year for maintenance fee(that is 35000.00 per year for 1 unit of 2 bedrooom). Did you get a ton of people involved?because I would like to be part of this.

I couldn't agree more. Count me in. Also, my "special assessment" was $375.00 and we have a every other year 2 br. Not only that, they have violated the terms of their letter, giving everyone until 2/28/2011 to pay before late fees, collection efforts, etc. I received a letter fro a collection agency dated 2/10/11 and when I called to complain, was told to ignore it but then I noticed they had assessed late fees and interest in JANUARY 2011, causing the special assessment to rise to $405. My consternatin goes back much further, though, to the promises of exchanging the week for anywhere in the world......We cant even get a local exchange in SC. This is the ultimate rip off. JH

Everyone needs to file a complaint with the Florida Dept of Business and Profwessional Regulation at the followoing address. Many comlaints filed to date. Calypso Cay is currently under review by the State. Address is:

Be specific re: ;your complaints.

One area I am concerned about is this so called Board of Directors and the so called Calypso Cay Vacation Villas Owners Association. I called every number at Calypso available and asked for the number of someone on weither of these boards to complain to and no one knew who these people were and one geltelman told me to just write to the board and when I asked who to write to, told me "who cares, just pay your money".

According to the state, this is public info and must be given out to owners.

Lets get it rolling and also, get a class action started.

Anyone take a detailed look at the "budget" sent out? The numbers DONT MAKE SENSE - I'm not an accountant, but I can enter their numbers into an excel spreadsheet.... If you read the definition for management fees it states "based on the contract between Calypso Cay Vacation Villas Owners Association, Inc. and Timescape Management, LLC, which stipulates themanagement fee is 15% of the total of the total annual operating expenses." Well there is a discrepency of over $105,000 between their estimated fees and what the fees SHOULD be. IS this where the "special assessment" goes??
WHO PREPARED this statement and shouldn't they be qualified to prepare these statements for an organization bringing in over 5 million dollars annually?!

Secondly, notice the credentials of the individual signing the letter, why is someone working for the management company being paid by the owner's association acting also as the agent for the association? Does that sound to anyone else like a conflict of interest? I'm sorry, I think this sounds way too fishy and I think it might be time to contact someone in the Osceola county prosecuter's office.

Crummy service and the run around I have come to expect, but openly ripping us off?! This is too much...

Hi Alexis, I am on bored with a class action, I am sick of the phone calls as I have not paid the special assesment. I have not received a bill for anything else yet but I have heard that we will be receiving an additional bill for a remodeling fee. This is getting to be a little much for something that I can only use every other year. And we have only stayed at Calypso Cay once. Let me know who I need to speak to or what else we need to do. Please contact me if you do a law suit. How can they send a bill around Christmas time with people losing there jobs and barely making it. This is very upseting and I don't have the money to pay and additional $290, along with maintenance fees coming up 4 months later for an amount of almost $500.00. I called them and asked how is this possible I was told the board of directors voted on this. Which is BS!!!

I had to pay $375 for this B.S Special Assessment Fee. I called and asked why I had to pay on top of my maintenance fee and was told that they had the right to charge for any and all upgrades. I asked how many special assessments I could receive in a year and was told as many as the board deemed necessary. this is a total scam and needs to be stopped. I think there are enough people to file a class action law suit and hope that someone reading this is an attorney and is willing to help us all out with this abuse

We also received this $375 special assessment fee. It was due January 30, 2011. We have not paid the fee as of today. Doubtful we will. The bill states there will be a $25 late fee, plus a lien against your timeshare. This place is shady. We need to act ASAP. What do we do next?

Hi Cora, Have you consulted a lawyer yet? Does it look like we have a good case? I am tired of this company as well. Everytime I try to book a week, they keep telling me I need to pay the maintenance fee for the year before I can use my week. When I stopped paying, they reported me to collection. Why should I pay for something I am not able to use!!

hi , we are pretty new to calypso cay, bought it in 2008, used one time. but today got a letter for assessement fee plus the late fee. We never received the bill before. I called and asked how many times we will be charged assessment fee and they told me that they don't know. Reading from comments, i am learning that it is not the first assessment fee. How many were there, let say in last 10 years. I also wanted to know what they upgraded and they don't know. Did annyone contact BOD? I want to talk to them. I also asked for them to break the payments since it is unexpected and in this economy, people cann't just pull out extra $300.

I am having the same exact problem with this company. I have been trying to get a hold of a person there to speak to them about it and I can never get through. I have waited on hold for over 15 mins on at least 5 occasions. I have decided to report them to Florida's better business bureau. Also I have contacted an attorney down in Flordia who said he will review my contract that I have with Calypso Cay and see if he can get a class action started if we have enough evidence against them. The attorney is Greg Stoner in FL. I would suggest that everyone call him so that he gets a feel for how many people we currently have for this class action lawsuit.

My bill wasn't even sent to me I got the collection agency before I got a bill. I paid 327 I think. To use my unit this year I paid.$467.70 last year plus,$195,$59,$77 to hold it and when I went to use it was told I had to pay an additonal $159 to interval for holding it on top of the three other numbers. I wanted to use two weeks that weren't mine. I had to pay an additional 480.49 maintenace this year plus $327 to the collections for siding upgrades I was told nd $39 for reservation and $37 for extra points. I haven't been able to exchange anywhere in 5 years and was told my maintenance fee would be only $149 each year for my life. I only own a week and can not see maintenace even that. I also was told if I didn't want to own my unit they would buy it back for what I paid plus $2000.00. The one year I did use my unit only two or three years old I found 22 problems with the unit including unclean tub, hug amounts of pubic hair in tub,unclean sheets with cheese stuck on, sink handle fell off,front door wouldn't lock, bed broken. Someone came into my unit each day to take out the garbage and ate my food, went through our stuff, left the tv on and plugged up the toilet. I want my money back for the unit and each years maintenance and extra fees.

Thank you for the info Alexis. I have owned the timeshare for about 10 years. It wasnt as bad in the beginning but the maintenance fees have doubled and the rooms are dirty and not kept up. I am upset about the assessment fee as well.

I also am greatly distressed by this special assessment. I have called to find out who is on this imaginary BOD, but just get the runaround. I was told that it is their understanding that it is comprised of owners. I doubt owners would be imposing such additional fees on themselves, especially in times like these. Nobody can tell me who it is comprised of with certainty. That sounds kind of fishy to me. My wife and I barely use their services. I am sure we could find equivalent or better accommodations for the same amount or less. This swindling has gone on long enough. I tried contacting a Greg Stoner in Orlando, FL today, and am awaiting a call back. Let's hope we can get some results.

Guess What! The so called Calypso Cay Vacation Villas Owners Associaton Board of Directors and the "Board of Directors" for Timescapes Management COrp LLC are one and the same. If you look at the Florida Secretary of State Web site and key in both boards, you will see that the Owners association is listged as a non-profit and the Timescapes as a LLC (FOr Profit). They both only have 4 people, the same people, on both. I believe that this is a fraud and a massive conflict of interest. Every one neeeds to file a BBB complaint, a State of FLorida complaint with the State Atty Gen OFfice, the Real estate commmission and the Sec of State, calling for an investigation and a suspension of the boards (and their illegial actions) pending such. I am going to try and contact this Greg Stoner as well Lok in my post above to alexis for the complaint address to get started (BOard of Public and Professional LIcensing for the State of Fl). We need a central point also to gather all of the folks who are as upset as we are.

I am also an owner that received this special assessment fee in December. According to the letter we had until feb. 28 2011(a 60 day notice)to pay or we would be turned over to a collection agency. I just received a letter dated 2/10/11 from Meridian collection agency for the balance due plus late fees.They didn't even wait until the February deadline. I also receieved a letter from ccay that if you pay your assessments in full by feb.28 2011 you will receive .64 reservation points per every assessment dollar paid. The points may be used for future reservations with limits of course. I have been an owner since 2004 with a biannual week reservation. I am supposed to be able to use my week this April. I have not paid the assessments or this years maintenance fees, but until I do I will not be able to make my reservation to this April. I am pretty much forced to do so before the end of the month or lose out on my week. Count me in if we can even do anything about this. I live in NY and have used this timeshare every other year for my family. They have twice messed up my reservations after I have arrived there.keep all of us posted on the site.

Today I called to calypso cay to deposit my week with interval international they told me I had to pay $290 for this B.S Special Assessment Fee. I ask operator calling himself John. Why I had to pay special assessment fee on top of my maintenance fee? First he said owner approved this fee, when I ask him I never receive any proxy in mail. Then he said board of director approved this fee. I ask him to show me on my contract I am responsible for this fee. He told me the only thing I can do to remove late fee. I ask him can I get name of Board of director or any one I can write to ,operate didn’t give me any name just told me writ to board at 4951 calypso cay Kissimmee ,FL 34746 . John also gives me phone #407-997-1600. I called this number; ask to talk to anyone in the Board of director or in accounting department again no name. I will be file a BBB complaint, a State of Florida complaint with the State Atty Gen Office, the Real estate commission and the Sec of State, calling for an investigation and a suspension of the board.

Assessment Fee: I just came upon this site as I was online trying to make reservations and very frustrated. I did pay the assessment fee and am trying to get reservations for April in FL.Guess I deposited late and now have to wait until 59 days before I travel. I figured that was this week but now they tell me I need to wait another week. With all the fees I could have had something else reserved at a lower price. I'm finding may of the exchanges offered are not the nicest places and most choices are in Orlando. I noticed the Interval book is not as thick and wonder if there are less choices overall. I am sick of there increasing fees and will file with the BBB.

Excuse my french, but regarding the special assessment and the maintenance fees, they got you by the nads. If you don't pay, 1. They turn you over to a collection agency who adds 33% collection fee to it, as wellas late charges and interest. 2. They will ruin our credit in the process.

The best thing is topush for some sort of class action. Also, like I said in an earlier post, every one needs to file with the state. I am persuing the line that the BOard is not representative of the owners and in fact, is the same board as the FOr profit Timescapes Management CO, which is the same as the Developer. DOes anyone remember an opportunity to be elected to the board????? or BOard elections, for that fact. Jim Hardin

I have not paid and refuse to pay until I get some answers from them. All these people care about is getting paid, but for what? If we are unable to use the timeshare there is no reason to pay. I am going to call the attorney today to see if he is willing to take the case and get this started!! If anyone has a facebook, myspace or network connections website them we need to get the word out there for everyone to come together!

Unfortunately, I paid the assessment, but not the interest or late charge, under protest. Last year, they damn near destroyed my credit with the Meridian COllectin Agency, the same one that sent out the notice, supposedly by error. Everyone will have to decide if they want to take that chance of a credit ding and 33 % collection fees which unfortunately, the State of Forida says is legal.. I cant afford to but I envy those who can. I agree that everyhone needs to come together somehow and file something to stop this mess. I hear that the maintenance fees will be ujp 10% this year......surprise! It's got to stop. Everyone needs to file not only with the BBB but with the state as well. I underfstand that the State has numerous complaints and they are going to investige or so they say. THe more they get, the more likely that will occur. Also, the BBB has already given Calyos Cay a "F" rating, so I'm not sure Calypso Cay cares, but everyone still needs to do it. Alexis, I have left several messages with that attorney you mentined, but have not gotten a call back. ANy idea what is going on with him? Mention to him the non profit Calypso Cay vacation villas owners association Board of Directors being the same as the TimeScape Management Co's FOR PROFIT BOard Of Directors being one and the same (the same 4 people) and one of the 4 is the developer (supposed owner). As I stated in anearlier post, if yo contact or look up on the Florida Secretary of state site, you will eee that the board of directors for Calypso Cay Vacation VIllas Owners Association is the same as the TIme Scappes Management group which is the same as the Others you mentioned. I also have contactrd Greg Stoner but have not gotten a reply. Another strategy is for someone with means to be the spokesperson for the group and all of us send you our prozies. According to the bylaws, any owner can request a list of the names of ALL owners and a mailing could go out, requesting their prozies and then, this situatin could be dealt with. THe state off FLorida regulates what can be in the bylaws.

:o Interval International and Meridian are owned you the same company. Resort Funding, Farmington and Textron are all the lenders. Calypso Cay, Timescape and Epoch are all one.

Calypso Cay is owned by 5 partners JAMES H. PUGH JR,(holds the most shares) KYLE D. RIVA, GREG JACOBY, can not recall the 4th ones name and finely Stephen W Bradley. Stephen is the managing partner who calls all the shots for Calypso along with being the president of the board of directors. Board of Directors is made up on Stephen, his girlfriend Lisa Torres (not his wife :o ) and a few bean counters all tight into Calypso, Timescape and Epoch.

Hope this helps connect some of the puzzle.

If this gets off the ground please include me. This is the third time they have misled me. 1st when we bought in the sales person showed us the 3 bdrm lock off unit as the one we purchased. When we went for our first week, we end up across the street in the refurbished "apartments" had to pay more and a new contract for what we had already supposedly purchased - suprise the salesman who sold us the timeshare the first time no longer worked there. the second is the second pool it was suppose to be a lazy river that my kids were looking forward to, when I asked about it they stated the owners voted and decided to do another regular pool instead --I'M AND OWNER AND NEVER GOT A NOTICE OR TO VOTE ON THIS CHANGE. 3 is this latest assesment fee and the ever increasing maint fees. I definitely want in on this lawsuit.

Forget about the State of Florida doing anything to help you with a complaint against Calypso Cay Vac. The Office of the Attorney General in Florida told me in 2010, that they would take my complaint, but they would not do anything to help me with my complaint against Calypso Cay Vac. Villas. You see this company brings money into the State of Florida. Please all of you that have been violated and extorted by Calypso Cay Vac. please file your complaints in your states with your Attorney Genral Office and let them file complaints against the State of Florida for allowing this company to knowingly operate illegally and extort people in the state of Florida. Like I said, the woman in the Attorney General Office told me she knew there were complaints against Calypso Cay Vacation Villas, and she would take my complaint, but that she would not do anything to help me with my complaint. She said I would have to get a lawyer myself and fight them.


You see, if a State is willing to allow a company to fradulently operate in their state and not do anything to stop the company, than it sounds like the State is ok with whatever the company is doing.

When I went online and checked out the James H. Pugh, Jr. - Chairman/CEO and the other partners, It was James H. Pugh, Jr. had done a lot for the State of Florida. Also, I saw that IRS at one time had James Pugh in court for taking $600,000, etc.money from a business he was part owner court. We must not give up on this matter. They want to make you pay them or they damage your credit. They have already damaged my credit, so I am going to fight these crooks to hell if I have to.

They are crooks and they can not get away this. I will send this complaint to Washington against them and the State of Florida. You all have to stick together and not give up.

Thank you for taking a leadership position in this class action against Calypso Cay. When I purchased a unit from them in 2006, I was assured that they would purchase the unit back from me at my request. When I made the request,the agent said that as long as they were still developing more units, they would not buy back my unit.

The fees and assessments have become excessive! My credit score has been adversely affected.

First of all I would like to say that just because people don't use their last name does not mean their not serious. Maybe they don't want to use their last name for security reasons. I believe that you will not find a lawyer in Florida to help with the complaints. it seems like every lawyer I HAVE already talked to in FL has not been interested. I just made a reservation at Calypso for my daughter it cost 49.00 to reserve my week, the next day I checked my bank account and THEY ALSO TOOK MY MAINTENANCE AGAIN 679.00. I called to ask why and it took me 45 min of waiting on hold to be told it was a mistake. THEY DID NOT HAVE AUTHORITY TO TAKE THAT MONEY OUT OF MY ACCOUNT. just goes to show you CALYPSO CAY CAN DO WHAT EVER THE HELL THEY WANT.

I already gave them my info...and we should have done research on this company first...so is everything about Calypso Cay a scam. They said stuff about Interval International.

Should We hurry up and NOT pay???
Cancel out of this timeshare???..I don't want to regret getting $$$ taken away if it is truly not a good deal.

We have had the time share for about 8 years. We have only stayed there once, we usually trade our week. We have been many places. What I am upset about is the maintenance fees and the special assesment fees. The maintenance fees have doubled since I have purchased. Also like I have stated before in my other posts, they promised a water park on site and that never happend.
So just recently I let my cousins use our week this year and they had trouble checking in. They told them they didnt have a reservation. I set that all up for them. They put them in a room that had old TV's in it and the washer machine was broke. What are they doing with all the money they collect from us for maintence fee's and special assesments??

THIS PLACE IS A JOKE. Not only do they charge for maintenance fees, assessment fees, they charge you to let your family use your week. so you pay 49.00 to make your reservation, then you have to pay a 49.00 to rent the week in your family's name. for something we thought we owned. I am trying to sell mine now and that is a joke as well. THE GOING RATE FOR A TIME SHARE IS ABOUT 3,000 . you have to pay someone to sell it. so we would walk away with maybe 1,000. they are ripping people off and I don"t think there is anything we can do.

The going rate for most timeshares is $1. You can't sell them and people will give them to you all day long. I've tried donating and no one will take them. Some places will take their deed back and write off the maintenance fees, but Calypso is not one of them.

I refuse to pay that since no upgrades have been made to this place and yet I have still not been able to use it. If anyone knows an attorney who is willing to take this case on, please let me know. I have 7 years paying always on time. By the end of last year a I lost my job and was unable to pay special assesment and the regular mant fee.. I called meridian today and they toll me 2 pay $$1050... DOUBLE IN HALF OF A YEAR... I feel assaulted. I dont think that is legal, but dont see any thing I can do. If some one find something please let me know.

This place has been a rip-off from day 1. First we were told that it didn't matter what week we were deeded because it was flex time and all red weeks. Of course we ended up with Opal (the worst) and of course, it does matter. We were sold the 3 BR lockoff and a big line of B.S. on how we could use it. They have been a nightmare to deal with every since. We paid $13,000 for an odd year only use. We were lied to by "Maria" in so many ways. We own 8 other timeshares. This is the only one that is impossible to deal with. I called to see if they would take the deed back and they said no. Big Surprise.

WE WANT IN ON A CLASS ACTION LAWSUIT!!! We purchased a timeshare with C Cay in 4/2010. We were mislead and lied to also. We initially inquired to the sales manager what to do with the timeshare if we wanted to sell it we were told no problem, C Cay wanted 1st dibs to buy it back. When inquired to have C. Cay buy it back we were told NO WE DON'T BUY BACK UNITS. We have also encountered other problems and deceptive tactics and are tired of the fraudulant run around. We are fed up with C. Cay. I spent numerous amounts of time chasing people to speak with and got NOWHERE. IF someone has an attorney that will help let us know. We plan to report these issues with the attorney general of PA [where we live] and FL.
