So on July 31, 2009, my family went to stay at a resort in Florida. We stayed at a friend\'s 3BD and 3Bath room. It was quite nice, and we thought we could use one, too.

So about half way into the week, we were called by a salesperson that if we were interested in the resort he would show us an open house. We went through it, and it looked pretty good. It was even by the lake. We went up to the office and were greeted nicely. We were smooth talked in about all the benefits and rewards, but forgot to ask about the regulations and restrictions. As we hurried to sign our first timeshare, we had to do a closing for the timeshare. We in fact did buy straight from the developer, and a lot of papers had to be signed. Because of time constraint and we had to hurry to go to Disney Hollywood's Studio, we quickly skimmed through the agreements.


After we signed all the papers and made a down payment, we were then told that the developer would not help us resale or rent. At first we were like okay, it should be able to resale with an agent afterwards. But when we arrived home, and went on the internet to research about this resort, a lot of complaints were filed in that timeshares were hard to resale/rent and that the maintenance fees increase without notice. We then thought of cancellation. What we didn't get was an agreement of the # of cooling off days we had (10 calendar days in this case). We checked the Florida senate laws, and one of them said that there is infact a 10 day cooling off period for cancellation without any penalties or obligations.

We then called the resort itself, and asked that we would like to cancel or room. They said okay, but they would charge the commission fees and service fees involved. They did not say how much, but they said they will just charge the credit card we are using until all the service fees are gone. We then turned to this site. We would like to ask, what should we do? Do we ask a certified lawyer office? Or send a written letter of cancellation with a copy of the law?

You do have the 10 days cooling off period by law. Follow the instructions telling you how to cancel and send a certified letter to the address shown on the contract. Do not talk to the sales people any more. Good Luck !

Florida has a good consumer affairs dept. I suggest you file a complaint
