I bought a timeshare in 2003 from Playa Del Sol under fraudulent sales practices--lies, lies, lies! Believe nothing they say if you are considering a purchase from them. I could go on and on ...
Currently I am fighting to have my purchase price refunded and membership rescinded and going through Profeco--the Mexican agency set up to help individuals dealing with such organizations. Upon initial communication with Playa Del Sol, they argued the points I outlined and refused to meet my demands. They said my terms were 'unacceptable.'
Regardless I am pursuing every avenue I can to have this situation alleviated, including contacting my local and nation Attorney Generals. If you are in a similar position I urge you to follow similar steps. This organization needs to understand buyers to have a voice!

To note, I tried to contact Playa Del Sol two times formally in writing asking for cancelation etc, which they ignored until involving Profeco. That must say something.
I will keep you updated.
In response to their lack of appearance, I have increased my response by sending my paperwork to my State Attorney General as well as by logging a complaint with the Better Business Bureau.
Playa Del Sol has not shown to the second arranged meeting with Profeco. So far Profeco has levied a $600 fine, more pending...
I have contact my local Attorney General and their response was as follows: "We are aware of the organization and please let us know should you hit a wall with Profeco. I have yet to hear back from the Better Buisiness bureau save they have received my complaint. Within the next week or so I will paste my letter to both the local state Attorney General and to the Better Business Bureau. Again, I urge anyone who feels they have been wronged by Playa Del Sol contact Profeco, his or her local Attorney General and the Better Business Bureau.
Playa Del Sol: If you responsibly settle this complaint I will stop posting on this page and others.
ALWAYS keep PLAYA DEL SOL in the know about what you are doing. Many people talk but take no action. AS WELL, I am always fishing for those who are interested in joining a CLASS ACTION LAWSUIT. Should mediation and pressure fail, there is always that option. If I can get a few folks interested (which there are) then the cost for retaining a lawyer is significantly reduced.

I was happy to find your comments and advice for Playa Del Sol. I too, was suckered into "ownership". At this point I would just like to get out. I am going to send your sample letter but really have no idea on how to proceed. I would be interested in joining a class action lawsuit.

Here is a copy of one of many communications I sent to Playa Del Sol as outlines on the complaint page. It elaborates to the particulars of my concerns and the poor business practices and details to what level I have attempted to sort this issue out. Should you need any other information please don’t hesitate to let me know.
Playa Del Sol Representatives:
We are hereby requesting cancellation (for the second time) of our Playa Del Sol Club Agreement #_________ (Contract # ______) and a full refund of our paid in full cost since the transaction was based on illegal sales practices and fraudulent information. We paid $_________ for the studio and are requesting the refund in full. The first notification was sent ______________ to date I have had no response. I have noted this with Profeco.
I have been bothered with the transaction for the past six years. I have not felt until recently, both financially and position wise, able to address this issue adequately. I am willing to seek any and all legal/governmental action in order to null the contract and gain a refund of costs. I am currently a member of ________________________ and have access to publications, legal representation and forums to discuss what I feel has been a grave business malpractice.
In ________________, my wife and I were persuaded to buy the timeshare while in Mexico. We were approached and persuaded by_________, a Playa Del Sol representative, to buy a timeshare. During his presentation he made several false statements.
Our Concerns/False Statements:
1. I was told I had to waive my “right to rescind” in order to take advantage of a credit purchase instead of cash purchase. I also called as soon as I returned from vacation (within the standard US 30 days) and was told I still could not rescind. In fact, I discovered that by Mexican law, this right cannot be waived.
2. I was told that a one-week rental of a 2 bedroom unit was renting for an average of $1500-1700. Actually, weeks like this are renting for less throughout the internet and have been for the past few years. Taking into consideration the maintenance fees and the actual cost of renting the unit, there is little chance of even breaking even.
3. We were concerned with resale value and John said the value increases because of the new resorts that are being built. He also stated that to control prices you must use a Playa Del Sol palace broker when selling your timeshare.
4._________ also referred me to a rental agency, Global Resort Services, which to date has not been able to rent the property. I have offered it as low as $200 he stated I could rent for as high as $2000.
5. __________ offered us alcohol during the presentation, which lasted more than an hour.
The alcohol came for the entire presentation. I was never told I had to pay for it until the very end.
I am sure you are working on all of the recent complaints I have seen about your sales tactics throughout the internet. I know you have settled some of them already and are not interested in having any more negative press.
I have SENT all my documents in order to file a case with Profeco and will wait for response before I send to the ______ Attorney General, US Dept of Justice, and the Federal Trade Commission, Better Business Bureau and any and all other entities who could help me resolve this issue.
Please grant my request to cancel my service agreement (contract #_______) account # _______ and send me verification of cancellation. Also please send a check for the $_________ we paid in full in_______ . I will then return any original documents you so request.
To note, getting Playa Del Sol to acknowledge my complaint to begin with took me threatening theses courses of action. I will update when they finally show up.

You do not have to be present at the PROFECO meetings. You have to contact them and initiate a complaint. They will contact you and arrange for all of the sessions after that. So far we have had 2 sessions and the results have been minimal. PROFECO has levied a $6000 fine against PDSG for non-compliance of requests for documents. There will be another meeting scheduled. PROFECO tells me that if I do not respond to their letter that they will drop the conciliation process and that this might impact my case if it went to the "Mexican tribunal".
I have been suggesting to PROFECO that I would be interested in cancelling my membership and have offered this as a solution to the dispute. This will be presented at the next session, I presume. I have also inquired about the Tribunal and want to know what exactly they can do for me. I have been in contact with a law firm who tells me that there is no suit I can bring against PDSG because they can only get back money fraudulently obtained at the initial purchase time. Since we have used the time share and been members since '06 there appears to be little or nothing we can do. All the talk we hear about "class action suits is really meaningless because there is nothing legal to sue for. Our contract seems to have been well written and no amount of breaching on PDSG's part seems to affect it. I am totally baffled by this since they have made so many changes to the original structure of their company that my contract doesn't seem to be applicable any longer. The one thing we can do is to use the law firm to cancel our contract. That will cost $1500 and take up to 6 months.
I will not be paying any more money to PDSG for maintenance or fees until this situation is resolved. I hope this response has been of some help.

Thank you very much for this information. My hope was that we could sue them for breech of contract. As you mentioned that the contract or their practice has changed so much that it does not resemble the document they provided. It would seem that there must be some kind of breech of contract somewhere.
However, in lieu of the information you provided, the only recourse may be to continue to pursue action with Profeco.
I found another option., a group that takes over timeshares for a fee. The price was $3000.00, this also seem negotiable. We did not pursue this yet. They made some very interesting points. One of particular note was the selling point of "Perpetuity", the idea that you own it for ever and can will it..etc. However, the reality means that they have you for a lifetime of payments or that you pay them whatever fee they decide for maintenance in Perpetuity .
We are going to purse a complaint with Perfeco for now. Maybe if enough people do the same, their fraudulent practices will cease. I would be interested in hearing how you case is progressing.

All timeshares are listed on these sites, these sites buy blocks of rooms from them to rent, even very popular timeshares like Marriotts vacationworld can be found on them, thats how I booked my first time with Marriott.
They directed me to Customer Service of course NO ONE Called me back!
This resort is horrible! Always has been always will be a FRAUDULENT RIPOFF!!!!
We actually bought some time at Grand Mayan and they exchanged our weeks with them for a credit...
Grand Mayan is AWESOME and has such better services!!!
I am not sure what to do as we bought 4 weeks - 2 - 2 bedroom and can't get reservations unless we book a year in advance normally.

I see that some have begun to purse claims agains PSD. I am also interested is pursuing this. I would like to get my money back. I there a possibility of or has anyone thought of pursuing a class action suit against PSD with regard to Fraud and Deception.
There are so many of us involved, can't we make a case of it and do something about it?
It sounded so great and honest money was given to the company.

We now have people offering to BUY the property, this seems to be another scam. Look it up on the computor. Thank God for the computor as we have the means to check up on things.
They just want us to walk away and forget about our honest money given to buy a nice opportiunity to go to Mexico
