This letter was sent to Budget Travel magazine in the hopes they will publish it. I would encourage others to do so also.

Unfortunately this is only too true and you may wish to publish this in a future edition as a warning. There is a timeshare organization Promotora Sunset Beach Clubs, SA de CV (Sunset Group) in Cancun that will be the recipient of a class action suit because of it’s selling practices. I am attaching a letter from the person who is gathering the resources to file the suit. He contacted The Department of Conciliation Services to Foreign Residents in Mexico to file a complaint but there is no resolution to date.
Promotora works closely with RCI and Bank of America. In our case, Promotora delayed canceling the contract for almost 11 months and BofA would not cancel the $10,000 charge without that documentation. Bottom line, BofA refused to cancel the charge because the time lapse for the dispute was past their deadline.
Interestingly, Promotora sent us the letter of cancellation from PMB 477, 444 Brickell Ave, Ste 51, Miami, Fl 33131-2942. That is a valid street number but on contacting the building management was informed the suite number was invalid as was PMB 477.
If you should happen to publish this letter as a warning, remind the readers that the shills at the airport should be avoided like the plague. I broke my rule this one time and, boy, did it cost!
I have traveled in Mexico numerous times and always have fun. And I have a Marriot timeshare that was an excellent purchase. I will never set foot in Cancun again and have steered friends and acquaintances away also.

Martha told me first that I waived my right of recission cause it cost them 7000.00 dollars to put us in a stinky hotel for 4 nites.. What a disgraceful story. Then she changed the story and said the email didn't count cause the registered letter was late. I asked if she was a lawyer and she said no.
She has now given us the option to get a 50% refund if we finance it .
That is not a refund.
I have emailed David Zambrano, who sends it to Martha but he does not have the courage to respond himself.
What kind of people will rip off a family who is facing such a burden as my wifes illness and treatment.
We are going to go public on TV and you tube and internet.
Please join us in emailing this organization and letting the world know that these people have to do the right thing

You should take action about it, do not just leave it on the hands of god.
Contact PROFECO in Mexico, this is the office in charge of these kind of affairs. They can get your contract canceled if you notified the resort within the first five days and you can prove it.

Does any of you know if it is possible to waive your right to cancel within 5 business days? The mexican law says you can cancel within 5 bus days. does any of you have invoked this law and gotten out of this deal?

I am in the same place as you. I was about to mail a check before I read your comment. Have you had a response about the Class Action lawsuit? I would be interested in joining as well. I thought that since I bought so long ago, perhaps I would not be eligible. Thanks for any info.
I have talked with Meridian Collections. They are part of the whole scam. They had all of the responses to issues I brought up. I basically told them that I would not be paying them for the maintenance. And that if they put anything on my credit, I would be filing a dispute for breach of contract.
We tried to contact the Sunset group a year or so later to sell the time share through this company. One of the sales pitches was the time share should go up 10% each year and they would sell it for us when we decided we would like to get rid of the property. The phone number they gave us never worked, and the gentleman's card that sold us the time share's number was no longer in service. We finally found them on the internet and we wrote to them and their reply was they wouldnt sell our time share. I would really like to know if there is any legal steps I could take as I do not appreciate the harrassment and the possible jeopardizing of my credit.
We've been contacted by the collection agency and won't pay a dime to crooks.
As asked above, is there a Class Action Lawsuit in motion and please point the direction.

I have spoken to 2 attornys, one was of no value the other was helpful. The Profedco route is both long and at best an exercise in frustration. This timeshare rip-off is a huge business in Mexico, a country rife with corruption across almost every government branch. There is evidence of payback between large time holding companies and government entities. The most logical approach would be to actually start a legal battle, including mustering US government involvement...then push for intervention by them. Sunset is NOT motivated or compelled by anything u or we say. The Mexican Government is NOT going to do anything unless pressured from the US government / or ligitimate legao action AND media exposure to their practices. BY oul be amazed how much bad press gets their attention... As for BofA, they are essentially playing the game of collecting financial services fees and care less about the illegal and unethical practices of Sunset Group. If you look at their involvement in the recent US financial markets implosion, you get some idea how little they care about doing the right thing. Approaching States Attorney Generals is not productive UNLESS we organize and approach an AJ in a state where they have a vested interested, like Florida. US and Canadian Commerce Departments are also a good source...but again we have to be organized. I think there are possibe startegies to get the Sunset Groups attention, but we have to be organized. Blogging is only good for venting ones spleen... If you go thru these blogs you will see a pattern that regardless of whether there is a cancellation clause or NOT if you sign the contract and pay a down payment expect they will NOT cancel your contract even if it is the SAME day! They state a 5 day cancellation clause, but most of the comments / experiences here are from folks who tried to cancel within 5 days! It's a rip off. I have been trying to cancelk since 9/26/2010!
I am taking these comments and seeking an international law attornet who is also tied to our US Department of Commerce. Individually we are up against a wall...but collectively we represnt a "class" of plaintifs.
We also cancelled the very next day while still at the resort and got a cancellation notice and a credit card refund receipt. My credit card company says not to expect a credit refund for another week, and if it does not go through to send them the notice and the refund receipt and that it should be no problem to get my credit back. I hope it all goes through and I will be rid of this headache. I am outraged for those that are still stuck in this nightmare.
After reading many sites and blogs, I found yours to be the most productive. My fiance and I are new victims of the scam of Sunset world and Tres Rios. We cancelled within 5 days,and yet they still will not honor the contract (no reason given why).
We were wondering if you could reccomend any legal help (affordable, if possible). Should we hire an attorney ASAP? Should we go back to Mexico as soon as possible? Did you find any help from federal agencies?
As I am asking for help, I want you to know we are with you in this fight and are willling to work with you to the fullest capacity in attacking Sunset on every front possible. We live in New York City though.
