This letter was sent to Budget Travel magazine in the hopes they will publish it. I would encourage others to do so also.


January 26,2008 Dear True Stories:

Unfortunately this is only too true and you may wish to publish this in a future edition as a warning. There is a timeshare organization Promotora Sunset Beach Clubs, SA de CV (Sunset Group) in Cancun that will be the recipient of a class action suit because of it’s selling practices. I am attaching a letter from the person who is gathering the resources to file the suit. He contacted The Department of Conciliation Services to Foreign Residents in Mexico to file a complaint but there is no resolution to date.

Promotora works closely with RCI and Bank of America. In our case, Promotora delayed canceling the contract for almost 11 months and BofA would not cancel the $10,000 charge without that documentation. Bottom line, BofA refused to cancel the charge because the time lapse for the dispute was past their deadline.

Interestingly, Promotora sent us the letter of cancellation from PMB 477, 444 Brickell Ave, Ste 51, Miami, Fl 33131-2942. That is a valid street number but on contacting the building management was informed the suite number was invalid as was PMB 477.

If you should happen to publish this letter as a warning, remind the readers that the shills at the airport should be avoided like the plague. I broke my rule this one time and, boy, did it cost!

I have traveled in Mexico numerous times and always have fun. And I have a Marriot timeshare that was an excellent purchase. I will never set foot in Cancun again and have steered friends and acquaintances away also.

[I have emailed them and followed up via registered mail.

Martha told me first that I waived my right of recission cause it cost them 7000.00 dollars to put us in a stinky hotel for 4 nites.. What a disgraceful story. Then she changed the story and said the email didn't count cause the registered letter was late. I asked if she was a lawyer and she said no.

She has now given us the option to get a 50% refund if we finance it .

That is not a refund.


I have emailed David Zambrano, who sends it to Martha but he does not have the courage to respond himself.

What kind of people will rip off a family who is facing such a burden as my wifes illness and treatment.

We are going to go public on TV and you tube and internet.

Please join us in emailing this organization and letting the world know that these people have to do the right thing

I have signed a contract, but have only put $1000.00 down. My wire transfer came back to me stating it was an incorrect beneficiary account, and now they want to have me send a credit card number. Is that how you got scammed???

We bought then had to cancel as my wife just found out she needs treatment for liver disease.We have notified them with in the 5 days via email, fax and registered letter to the domicile address in Miami. We spoke to the sales manager Sam by phone and he offered to give us half of the money back. Then we could make 950.00 per month payemnts for 2 years. We need the refund to pay for my wifes treatment but are still waiting for a yes or no. Two weeks and counting.
Please pray for us that they do the right thing.

Hello Allan,

You should take action about it, do not just leave it on the hands of god.
Contact PROFECO in Mexico, this is the office in charge of these kind of affairs. They can get your contract canceled if you notified the resort within the first five days and you can prove it.
This is their site, look for contact info towards the middle of the page, the section is called "Atencion a residentes en el extranjero" that is for people outside Mexico:

I just returned from a trip to Cancun and was scammed into buying a timeshare in Tres Rios. I am sending a certified letter to the company in Miami to cancel the contract. I am concerned it is a mail box and i do not have an email to notify them. Does anyone have better address and an email to contact them today?
Does any of you know if it is possible to waive your right to cancel within 5 business days? The mexican law says you can cancel within 5 bus days. does any of you have invoked this law and gotten out of this deal?

i was also ripped off from this company as well, what we thought was a great deal apparently wasn't. I purchased this back in 2003 or 2004, and when we were flying home after talking to several passangers on our flight, they received better deals then us, i tried to cancel my contract as soon as we returned home and i was told i couldn't and then they rewrote my contract giving me more coroporate week. dont know what to do at this point had to put the balance on a credit card, i have asked several times for them to buy it back but they keep advising they dont nee the inventory. any suggests would be great

We purchased our time share at Susnset Fisherman, 6 years ago. We were told that we would be able to rent our timeshare and make money on this. We were able to make a reservation the following year without any problems. since then we have not been able to make any reservations. The resort was hit 2 years in a row by hurricanes. Our maintenence fees went up to cover damages, but we were not able to reserve any time. We attempted to make reservations for 2 years afterward and have just written off our $20,000. We just received a collections notice for all of the outstanding maintenence fees. We would be very interested in joining the Classaction lawsuit.

I have talked with Meridian Collections. They are part of the whole scam. They had all of the responses to issues I brought up. I basically told them that I would not be paying them for the maintenance. And that if they put anything on my credit, I would be filing a dispute for breach of contract.

I was recently notified that I owed $3183.91 for cleaning of a time share I never used and lost in a divorce. A collection agency Meridian Financial has told me because my name is on the contract that I am liable.
We tried to contact the Sunset group a year or so later to sell the time share through this company. One of the sales pitches was the time share should go up 10% each year and they would sell it for us when we decided we would like to get rid of the property. The phone number they gave us never worked, and the gentleman's card that sold us the time share's number was no longer in service. We finally found them on the internet and we wrote to them and their reply was they wouldnt sell our time share. I would really like to know if there is any legal steps I could take as I do not appreciate the harrassment and the possible jeopardizing of my credit.

Total misrepresentation and you will NOT get the advantages explained by their sales staff. We attempted every effort to make this work and gave up.
We've been contacted by the collection agency and won't pay a dime to crooks.

As asked above, is there a Class Action Lawsuit in motion and please point the direction.

We were taking in by a conartist that worked for sunset finding out he's has been fired and is wanted from what was told by Jerman (another timeshare selling rep). I own a timeshare at Sunset with a couple others. We've encountered broken promisses such as they will sell it for us when we want to sell it. A fake contract shown during the presentation vs the real contract that was signed. Got us drunk BEFORE the presentation as he kept ordering drinks for us "on the house". Please let us know also if a class action lawsuit is in the works!!

I have spoken to 2 attornys, one was of no value the other was helpful. The Profedco route is both long and at best an exercise in frustration. This timeshare rip-off is a huge business in Mexico, a country rife with corruption across almost every government branch. There is evidence of payback between large time holding companies and government entities. The most logical approach would be to actually start a legal battle, including mustering US government involvement...then push for intervention by them. Sunset is NOT motivated or compelled by anything u or we say. The Mexican Government is NOT going to do anything unless pressured from the US government / or ligitimate legao action AND media exposure to their practices. BY oul be amazed how much bad press gets their attention... As for BofA, they are essentially playing the game of collecting financial services fees and care less about the illegal and unethical practices of Sunset Group. If you look at their involvement in the recent US financial markets implosion, you get some idea how little they care about doing the right thing. Approaching States Attorney Generals is not productive UNLESS we organize and approach an AJ in a state where they have a vested interested, like Florida. US and Canadian Commerce Departments are also a good source...but again we have to be organized. I think there are possibe startegies to get the Sunset Groups attention, but we have to be organized. Blogging is only good for venting ones spleen... I have been following this blog for months and no one has identified the WHO or HOW behind who is championing the CAS (Class action suit).my email address is

We just returned home after a similar issue. We did cancel the contract and received, in writing, that are contract was cancelled. We also signed the for the credit back to our card. I checked our statement and the charge is still there. I contacted American Express and was told no credit was issued. It is now under dispute. Again, we have the signed statement, with signatures, stating that our contract was null and void and the signed credit to our card. Hopefully, there is just a delay in the credit back to our account.

We need someone to take the lead and we will all sign and get our $ back and our contract cancelled. There is a solution for eevery problem.

If you go thru these blogs you will see a pattern that regardless of whether there is a cancellation clause or NOT if you sign the contract and pay a down payment expect they will NOT cancel your contract even if it is the SAME day! They state a 5 day cancellation clause, but most of the comments / experiences here are from folks who tried to cancel within 5 days! It's a rip off. I have been trying to cancelk since 9/26/2010!
I am taking these comments and seeking an international law attornet who is also tied to our US Department of Commerce. Individually we are up against a wall...but collectively we represnt a "class" of plaintifs.

We actually had a signed cancellation from Sunset Group and a credit slip for our credit card but when I spoke to American Express the credit still had not came through. I called and spoke to the sales person and he said that it should be credited in 15 days----we will see.

We also cancelled the very next day while still at the resort and got a cancellation notice and a credit card refund receipt. My credit card company says not to expect a credit refund for another week, and if it does not go through to send them the notice and the refund receipt and that it should be no problem to get my credit back. I hope it all goes through and I will be rid of this headache. I am outraged for those that are still stuck in this nightmare.

After reading many sites and blogs, I found yours to be the most productive. My fiance and I are new victims of the scam of Sunset world and Tres Rios. We cancelled within 5 days,and yet they still will not honor the contract (no reason given why).

We were wondering if you could reccomend any legal help (affordable, if possible). Should we hire an attorney ASAP? Should we go back to Mexico as soon as possible? Did you find any help from federal agencies?

As I am asking for help, I want you to know we are with you in this fight and are willling to work with you to the fullest capacity in attacking Sunset on every front possible. We live in New York City though.

I've been a member with Sunset for over 6 years and originally purchased a 2bdrm, but have never been able to get a 2brm because one is never available. Their services are horrible and I wish I could cancel my membership. The maintenance fees keep coming and if you don't pay them they go directly to a collection agency. There is no recourse for their terrible service or practices.

we bought a timeshare at the sunset lagoon resort in cancun, mexico 3 years ago, costing about $12500. we were faithfully promised that if ever we needed to sell our investment the sunset group would always buy it back, probably at a greater price than we paid! they even showed us documents relating to a resale they´d just done. we have never been able to use the timeshare due to changed financial circumstances after we returned to the uk. we have tried relentlessly over the past 2 years to get the group to repurchase it but to no avail. we also paid $500 to a company who promised they could sell it, also no joy! in hindsight we realise how stupid we were to buy in the first place but the sales team made it look very attractive, a solid investment and were very persuasive! would definitely like to know about this class action law suit please

We had a terrible experience with Sunset Group. We are interested in a class action suit as well. We purchased in 2001 and paid it off. We tried to book vacations but had problems trying to book a vacation. After it was paid off, they more than doubled our maintenance fees. We knew we were scammed and sent notice to cancel the contract. Here we are nearly a decade later and Meridian financial has split up the maintenance fees into separate accounts and put it in as collections on my credit report. I have not recieved anything from this company in writing. I currently have 3 meridian collections showing and it's killing my credit score! All of my credit card rates and even my car insurance has gone up. I have disputed it but they confirmed the debt with the reporting agency. I am now faced with taking them to court. I will never buy a time share again!

I also bought a timeshare with Sunset Club Lagoon in Cancun Mexico. I paid off the timeshare and in four years was not able to use one week; they never had availability. I tried to contact them to sell back timeshare but could never reach them. After six years, I get a letter from a collection agency that I owe Sunset Club Lagoon 6,000 in maintenance fees, late charges and deliquent charges. They never sent me a bill or notified me that they were sending me to collections. I also want to join the class lawsuit.

My husband and I too were scammed by Tres Rios. Since I got nowhere with the Sunset Group I've recently filed claims with SD Division of Consumer Protection, International Consumer Protection and Enforcement Network (ICPEN), the US Consulate General, and the Consumer Protection Agency (PROFECO). I'm hoping one of them will respond and I'll update this blog if/once they do. Also - I was not able to find any information on a Class Action Suit against Sunset Group/Tres Rios. If anyone has found information on this please post.

So many comments about people Sunset has done wrong in one way or another. Why has there not been any true action taken? My husband and I were in Cancun in Nov 2011. Our salesman took out photo ID's to make a copy of them & ultimately held them in their possession until after we finally gave in and signed the papers. We asked for our ID's to be returned to us multiple times and our requests were ignored. I feel like we were held against our will and forced to give into their dirty sales tactics. Like many others have stated, we sent written notification of our cancellation within the 5 days and were told that we "waived the right to cancel by receiving the benefits of the club". This is compelte and total bull crap! How can the same basic story continue to play out? There has to be some way to stop these people, or at least put a halt in their game. I have not come across anyone else who mentioned having their identification held from them, is this a new tactic they have found beneficial? I hope we were just the victim of one saleman's extremely unethical tactics. I don't understand how the US government can continue to allow Mexican companies to commit such fraud against US citizens. I thought that the USA was a powerhouse of sorts & that we have rights as consumers (in any country, not just Mexico). I am very disturbed by what happened to us and I have never fell victim to any scams. We would not have been a victim of this scam either if they had not held our IDs from us because we never had intentions of buying into their timeshare. All timeshares (in the US and abroad) have their problems and not everyone will be satisfied, but seriously? Holding someone in a room against their will until they give in??? Isn't that really overstepping the boundaries?!!!!???
